1. PROMOTION DESCRIPTION: The 2025 Make-A-Wish^® Massachusetts and Rhode Island “Stream For the Wishes” Sweepstakes (the “Sweepstakes”) begins on June 1, 2025 at 12:00 am Eastern Time (“ET”) and ends on June 30, 2025 at 11:59 pm ET (the “Sweepstakes Period”).

The sponsor of this Sweepstakes is Make-A-Wish^® Massachusetts and Rhode Island (“Sponsor”).

This Sweepstakes is subject to all applicable federal, state and local laws and regulations and is void where prohibited or restricted by law.

By participating in the Sweepstakes, you unconditionally accept and agree to comply with and abide by these official rules (“Official Rules”) and the decisions of Sponsor, which shall be final and binding in all respects. Sponsor is responsible for the overall administration of the Sweepstakes. 2. ELIGIBILITY: This Sweepstakes is open to legal U.S. residents of Massachusetts and Rhode Island who are at least eighteen (18) years of age and have reached the legal age of majority in their jurisdiction of residence at the time of entry (each an “Entrant,” and collectively, “Entrants”). Sponsor and its parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies and each of their respective officers, directors and employees, are ineligible to enter the Sweepstakes or win a prize. Household Members and Immediate Family Members of such individuals are also not eligible to enter or win. “Household Members” shall mean those people who share the same residence at least three months a year. “Immediate Family Members” shall mean parents, stepparents, legal guardians, children, stepchildren, siblings, stepsiblings, or spouses. In the event that a dispute regarding the identity of an Entrant or potential winner (each a “Winner,” and collectively, “Winners”) cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible. Entries will not be acknowledged except as provided herein.

3. PRIZES: The following prizes are available in the Sweepstakes:

Limit one (1) prize per Entrant and per household. Prizes cannot be transferred, redeemed for cash, or substituted by Winner. If a prize cannot be awarded due to circumstances beyond the control of Sponsor, a substitute prize of equal or greater retail value may be awarded, in Sponsor’s sole discretion. If Winner cannot accept a prize, or any portion thereof, as stated, the prize may be forfeited at the sole discretion of Sponsor. The value of each prize listed above represents Sponsor’s good faith determination of the maximum retail value thereof. That determination is final and binding and cannot be appealed. If the actual value of the prize turns out to be less than the stated ARV, the difference will not be awarded in cash. Sponsor makes no representation or warranty concerning the appearance, safety, or performance of any prize awarded. Sponsor will not replace any lost or stolen prize items. No refunds or credit for changes are allowed.

This Sweepstakes is open to legal U.S. residents of Massachusetts and Rhode Island. Prizes will only be awarded and/or delivered to persons legally residing in said locations. Winner(s) will be solely responsible for all federal, state and/or local taxes, fees, and surcharges (if applicable), including (but not limited to) fees or costs associated with the prize they receive, as well as the reporting consequences thereof. Failure to comply with the Official Rules may result in prize forfeiture. Other restrictions, conditions, and limitations may apply.

4. HOW TO ENTER: Eligible Entrants may enter the Sweepstakes by any of the following methods:

ALTERNATIVE MEANS OF ENTRY: In lieu of the above methods, you may enter the Sweepstakes by emailing your full name, email address, daytime phone number, and residential address to dsadaka@massri.wish.org using the subject line “Make-A-Wish Massachusetts and Rhode Island “Stream for Wishes” Sweepstakes – Alternative Entry.”

Limit of one (1) entry per eligible Entrant for the duration of the Sweepstakes Period. Entries must be received by June 30, 2025 at 11:59 pm ET. If any Entrant exceeds the entry limitations, the Entrant may be disqualified, at the Sponsor’s sole discretion. Entries generated by a script, macro, or other automated means will be disqualified. Incomplete, unreadable, or unintelligible entries will be disqualified. All information provided by Entrants becomes the property of Sponsor.

ELIGIBLE ENTRANTS MUST SUBMIT THE REQUESTED ENTRY INFORMATION IN ACCORDANCE WITH THESE OFFICIAL RULES. NO OTHER METHOD OF SUBMISSION WILL BE ACCEPTED.

Participation in the Sweepstakes constitutes Entrant’s understanding of, full and unconditional agreement to, and acceptance of these Official Rules. Sponsor reserves the right to disqualify any Entrant that Sponsor determines to be in violation of any term contained in these Official Rules. Sponsor’s decision not to enforce a specific provision of these Official Rules does not constitute a waiver of that provision or of the Official Rules generally. Sponsor has the right to change the Sweepstakes Period and all other dates or deadlines set in connection with this Sweepstakes at any time and in its sole discretion. Notice of any such changes will be posted on [massri.wish.org/SFTWsweepstakes].

5. DRAWING AND WINNER SELECTION: Sponsor is solely responsible for the collection and processing of entries. A random drawing will be conducted by Sponsor the week of July 7, 2025 to select the Winners from among all eligible entries received. Odds of winning will vary depending on the number of eligible entries received.

6. WINNER NOTIFICATION: Within approximately 10 business days after the random drawing, potential Winners will be notified by email and/or telephone, at Sponsor’s sole discretion, using the contact information provided at the time of entry. Sponsor is not responsible for any delay or failure to receive notification for any reason, including (but not limited to) inactive email account(s) or telephone numbers, related technical difficulties, or failure to adequately monitor email account(s) or voicemail boxes.

Notified potential Winners may be required to verify, address, sign, and return an affidavit of eligibility and release of liability, and, unless prohibited by law, a publicity release and other legal documents as may be required by Sponsor in its sole discretion (collectively, the “Prize Claim Documents”). Failure to return the Prize Claim Documents within 72 hours may result in forfeiture of the prize and selection of an alternate potential Winner from the remaining eligible entries. Sponsor will attempt to contact up to three (3) potential Winners for each prize in accordance with the above procedure, after which a prize may go unawarded if it remains unclaimed. Sponsor reserves the right to disqualify anyone not fully complying with the Official Rules.

Winner(s) will be solely responsible for all federal, state and/or local taxes, fees, and surcharges (if applicable), including (but not limited to) fees or costs associated with the prize they receive, as well as the reporting consequences thereof. Winners of prizes valued over $600 are responsible for reporting and paying applicable taxes in accordance with IRS regulations. Other restrictions, conditions, and limitations may apply.

7. PRIVACY: Any personal information supplied by you to Sponsor will be subject to Sponsor’s privacy policy posted at https://wish.org/privacy-policy. By entering the Sweepstakes, you grant Sponsor permission to share your email address and any other personally identifiable information, including information and/or materials provided at the time of entry, with necessary parties for the purpose of administration and prize fulfillment or as otherwise outlined herein and/or in Sponsor’s privacy policy.

8. LIMITATION OF LIABILITY: By entering this Sweepstakes, Entrants waive all right to, and hold the Sponsor harmless from, any claim, liability, loss, damage (including punitive, incidental, and consequential damages), or expense (including attorneys’ fees) arising out of or in connection with participation in this Sweepstakes or the acceptance, use, or misuse of any prize. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. Sponsor will not be responsible for: late, incomplete, or incorrect entries; an Entrant’s failure to receive prize notices due to an Entrant’s spam, junk email, or other security settings or for an Entrant’s provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in this Sweepstakes; any human error that may occur in the processing of the entries in this Sweepstakes; or any typographical, technological, or other error in the publishing of the offer, administration of the Sweepstakes, or announcement of the prizes. If, in the Sponsor’s opinion, there is such an error, or there is any suspected evidence of tampering with any portion of the Sweepstakes, or if technical difficulties (including viruses and bugs) compromise the integrity of the Sweepstakes, Sponsor reserves the right to, in its sole discretion, cancel or modify this Sweepstakes in a manner it deems appropriate. In the event of termination, Winners will be selected from among all eligible entries received as of the date of termination.

9. CHOICE OF LAW AND FORUM: Entrant agrees that all matters arising out of or relating to this Sweepstakes and these Official Rules are governed by, and construed in accordance with, the laws of the Commonwealth of Massachusetts, without giving effect to any of its conflict of law provisions thereof. Entrant further agrees that any legal suit, action, or proceeding arising out of or relating to this Sweepstakes and these Official Rules that cannot be resolved between the parties shall be resolved individually through binding arbitration, without resort to any form of class action, in accordance with the arbitration provision set forth below.

10. ARBITRATION PROVISION: By participating in this Sweepstakes, each Entrant agrees that (1) any claim, dispute, or controversy (whether in contract, tort, or otherwise) the Entrant may have against Sponsor arising out of, relating to, or connected in any way with the Sweepstakes, the awarding or redemption of any prize and/or the determination of the scope or applicability of this agreement to arbitrate, will be resolved exclusively by final and binding arbitration administered by JAMS and conducted before a sole arbitrator in accordance with the rules of JAMS; (2) this arbitration agreement is made pursuant to a transaction involving interstate commerce, and shall be governed by the Federal Arbitration Act (“FAA”), 9 U.S.C. §§ 1-16; (3) the arbitration shall be held in Boston, Massachusetts; (4) the arbitrator’s decision shall be controlled by the terms and conditions of these Terms and Conditions and any of the other agreements referenced herein that the applicable participant may have entered into in connection with the Sweepstakes; (5) the arbitrator shall apply Massachusetts law consistent with the FAA and applicable statutes of limitations, and shall honor claims of privilege recognized at law; (6) there shall be no authority for any claims to be arbitrated on a class or representative basis, arbitration can decide only the Entrant’s and/or Sponsor’s individual claims; the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated; (7) the arbitrator shall not have the power to award punitive damages against the Entrant or Sponsor; and (8) with the exception of subpart (6) above, if any part of this arbitration provision is deemed to be invalid, unenforceable or illegal, or otherwise conflicts with the rules of JAMS, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. If, however, subpart (6) is found to be invalid, unenforceable or illegal, then the entirety of this Arbitration Provision shall be null and void, and neither Entrant nor Sponsor shall be entitled to arbitrate their dispute.
